Trump administration blocks asylum claims by those crossing border illegally

With the administration unveiling a new policy Thursday night that will expedite deportations of people who cross into the U.S. illegally and deny previously legal asylum claims and sign an executive order on that policy Friday morning, the White House is prepared for the lawsuits likely to be brought against it.

US President Donald Trump signed a proclamation on Friday suspending the entry of migrants through the US southern border between ports of entry for 90 days.

The Trump administration unveiled new rules on Thursday to sharply limit migrant asylum claims by barring individuals who cross the United States southern border illegally from seeking asylum.

"Congress has directly spoken to this question as to whether individuals can be rendered ineligible for asylum if they cross between ports of entry and has specifically said people are eligible regardless of where they cross", said Lee Gelernt, an attorney with the American Civil Liberties Union.

A senior administration official said the White House hopes that by funneling asylum claimants to ports of entry, officials will be able to assess and adjudicate the claims more rapidly.

"In its rush to obstruct asylum seekers, the administration is attempting an end run around the law", Beth Werlin, executive director of the American Immigration Council, told the Guardian.

Officials have turned away asylum seekers at border crossings because of overcrowding, telling them to return later.

Trump has long said those seeking asylum should come through legal ports of entry.

This is expected to put a dent in those streaming into an already overburdened system, officials said, noting that there is a backlog of more than 700,000 cases in the immigration courts.

USA law gave migrants seeking asylum a legal obligation to have their claims heard if they feared violence.

All of that said, as Pompeo noted on Friday, the waivers are not full waivers. "This is an economic war against Iran but". The main objective from the U.S. side is to force Iran to accept most - if not all - of its 12 conditions and demands".

The caravan has remained undeterred, and participants said they plan on applying for asylum at an official port of entry. Claims have spiked in recent years, and there is a backlog of more than 800,000 cases pending in immigration court, with a wait time that can be almost two years.

The new changes were likely to be met with legal challenges, too.

In 2017, the USA fielded more than 330,000 asylum claims, almost double the number two years earlier and surpassing Germany as highest in the world. "It is illegal to circumvent that by agency or presidential decree", the ACLU said.

But US officials said that as Mexico is the first safe country US-bound migrants from Guatemala, El Salvador and Honduras arrive in, the asylum claims should be presented there.

It's unclear how many people en route to the USA will even make it to the border. Before the midterm elections, Trump mulled ending birthright citizenship - the policy that ensures all children born on United States soil are automatically citizens - by executive order.

Similar caravans have gathered regularly over the years and have generally dwindled by the time they reach the southern border.
