Woman in loveless marriage with 'patronising' husband denied divorce

There are calls for Britain's antiquated divorce laws to be changed, after the Supreme Court unanimously ruled that a woman who wants to separate from her husband must remain "locked in a loveless" married.

Tini Owens, 68, must stay married to her husband Hugh - who is refusing to agree with a divorce - until 2020, BBC News reported.

"This ruling from the Supreme Court about the need to prove unreasonable behaviour under the Matrimonial Causes Act 1973, underlines the importance of the bill introduced by Baroness Butler-Sloss, which seeks to make the first major changes to divorce legislation in almost 50 years".

Given that there are 106,000 divorces each year in England and Wales it might seem surprising that she could not get a divorce.

He added: "Mrs Owens is devastated by this decision, which means that she can not move forward with her life and obtain her independence from Mr Owens".

One Supreme Court judge said she reached her conclusion with "no enthusiasm whatsoever" but that Parliament would have to decide whether to introduce "no-fault" divorce on demand. In their decision, they said that she had failed to establish that their marriage had irretrievably broken down. This led her to feel "unhappy, unappreciated, upset and embarrassed", and after many years, she said that she had "grown apart from him".

On Thursday 25 July, the Supreme Court refused Mrs Owen's appeal.

Past year three appeal judges ruled against dismissed Mrs Owens' challenge to that decision after a Court of Appeal hearing in London. The family lawyers" organisation Resolution said it showed there was a "divorce crisis'.

She said that her husband, whom she married in 1978, had behaved in such a way that she could not reasonably be expected to live with him.

Freedom to marry and divorce are both guaranteed by the law, but partners must uphold the "dignity of marriage", Li said. She describes such petitions as being "conduct-based" rather than "fault-based", the terms "unreasonable behaviour" being misleading (as Mrs Owens had initially pointed out, this term does not appear in the legislation).

Another said Parliament had "decreed" that being in a "wretchedly unhappy marriage" was not grounds for divorce. Even spouses mutually seeking to end a marriage must, unless they have been living apart, assign blame and make often damaging allegations that lawyers say inflame potentially amicable proceedings.

She said she had been "reluctantly persuaded" that Tini's appeal should be dismissed.

In issuing their ruling, the justices made their unease plain, noting that society's expectations for reasonable behaviour have changed since divorce laws were last updated in 1969 and marriage is now seen as a partnership of equals.

Previous courts found that her examples of his bad behaviour - needed to grant a divorce - were "flimsy" and "isolated incidents", with the case eventually making it's way to the Supreme Court.
