DNA Test Reveals Fertility Doctor Fathered His Patient's Child Without Her Knowing, Lawsuit Alleges

The woman, who lives in Washington state, US, said she learned through an Ancestry.com DNA test that her biological father was her parents' fertility doctor. However, when she discovered her paternal match was the doctor who delivered her, she confronted her now-divorced parents.

The lawsuit alleges Mortimer used his own sperm for the procedure, secretly and against the couple's wishes to use a college student. Mortimer reportedly told the couple that the issue was caused by the husband's low sperm count and the wife's tipped uterus; so, he suggested that the wife be inseminated with a mix of the husband's sperm and that of an anonymous donor to increase the changes of conception.

According to the lawsuit, Ashby and Fowler agreed to do the operation but only if the donor had physical characteristics similar to Fowler - brown hair, blue eyes and over 6 feet tall.

The Ashby, Fowler and Rowlette are suing Dr. Mortimer, now-retired, along with Obstetrics and Gynecology Associates of Idaho Falls, where he used to practice, for battery, fraud, intentional and negligent emotional distress, breach of contract and medical negligence, among other charges. When Ms. Ashby saw Dr. Mortimer's name, she was devastated.

Ms Ashby recognised the name and contacted her now ex-partner, Howard Fowler.

In order to be matched with someone on Ancestry.com, the website explains that both people have to be in the AncestryDNA database. When she received the report from Ancestry.com in July 2017 connecting her to Mortimer, she dismissed the results as a mistake.

In May of 1981, Fowler and Ashby welcomed a baby girl, a child who Mortimer delivered himself.

According to the lawsuit, Rowlette was horrified.

Ancestry.com's Chief Privacy Officer Eric Health told USA TODAY that while Ancestry.com does help to "make new and powerful discoveries about their family history and identity", it also might lead to "unexpected connections". Her parents had used Mortimer's services back when they were trying to get pregnant, and apparently he managed to pull a fast one on them. "With Ancestry, customers maintain ownership and control over their DNA data".

This isn't the first time a male doctor has been accused of using his own sperm in a fertility treatment procedure. He was sentenced to five years in prison and ordered to pay $116,805 in fines and restitution.
